Terms & Conditions for WitSpeak
Effective Date: August 26, 2026
These Terms & Conditions (“Terms”) are an agreement between you and ZenithNexus AI Technologies LLC governing your use of WitSpeak, including the mobile app, website, content, AI feedback, and related services (together, the “Service”).
1Acceptance of terms
By creating an account or using WitSpeak, you agree to these Terms and acknowledge our Privacy Policy. Creating an account also confirms the voice-data disclosure shown at signup: when you use speaking features, WitSpeak records, analyzes, and stores your voice and speech-analysis data to provide feedback, track your progress, and improve its pronunciation models, as described in the Privacy Policy. If you do not agree, do not use the Service. For individual accounts you must be at least 13 years old, and at least the digital-consent age of your country if it is higher (up to 16 in parts of the EU). Children below those ages may use WitSpeak only through an authorized WitSpeak for Schools program with the consent of a parent or guardian, as described in section 10 and in our Privacy Policy. If you are under 18, you may use the Service only with the consent of a parent or guardian, or through an authorized school program.
2What WitSpeak is
WitSpeak is an AI-powered English speaking coach for practice and learning. It is an educational tool: it does not provide official exam scores, admissions decisions, immigration advice, or guaranteed test results, and no output of the Service is professional advice of any kind.
3No affiliation
WitSpeak is not affiliated with, endorsed by, or connected to IELTS, TOEFL, Cambridge, IDP, British Council, ETS, Apple, or Google. All trademarks belong to their respective owners.
4Accounts and eligibility
When you create an account, you agree to:
- Provide accurate account information and keep it up to date.
- Keep your login credentials secure and not share your account.
- Use the Service only for your own personal, non-commercial learning (unless you have a separate written agreement with us, such as a school program).
- Be responsible for all activity that happens under your account.
An account is required to make purchases so that your plan can be restored across your devices.
5Subscriptions, trials, and purchases
- Some features require a paid subscription; we also offer one-time credit packs (“Boosts”) that unlock additional usage.
- Purchases made in the app are processed by Apple (App Store) or Google (Google Play) under their payment terms.
- Subscriptions renew automatically until canceled. Cancel anytime in your Apple or Google subscription settings at least 24 hours before the current period ends; you keep access until the end of the period you paid for.
- If a subscription starts with a free trial, it converts to a paid subscription unless you cancel before the trial ends.
- Deleting the app does not cancel a subscription.
- Prices may vary by country, platform, plan, and promotion, and may change; changes apply no earlier than your next renewal.
- Your purchase is also subject to the App Store or Google Play terms. Apple and Google are not parties to these Terms and have no obligation to provide support for WitSpeak; where an app store’s rules require, the store operator is a third-party beneficiary of these Terms and may enforce them.
- Refunds for App Store and Google Play purchases are handled under Apple’s and Google’s refund policies. Nothing in these Terms limits refund rights you have under mandatory consumer law.
6Fair use and usage limits
Speaking practice, AI feedback, and other features are subject to fair-use limits that depend on your plan. Limits exist because live AI conversation has a real per-minute cost. We may adjust limits to keep the Service sustainable; your plan’s current limits are always shown in the app.
7AI feedback and limitations
WitSpeak uses AI to hold conversations and generate feedback, analysis, score estimates, and answer rewrites. AI output may be incomplete, inaccurate, or unsuitable for your situation. Use it as learning guidance — not as an official evaluation, and not as a promise of any exam outcome.
8Your content
Your content includes your spoken answers, recordings, transcripts, written responses, and anything else you submit to the Service. You own your content. You grant us a limited license to host, process, and display it as needed to operate the Service: to generate feedback, sync your history across devices, keep the Service safe, and improve how WitSpeak teaches. As disclosed when you create your account, practice recordings from speaking features are kept and used to evaluate and improve WitSpeak’s own speech and accent models, as described in the Privacy Policy; you can turn this off, and delete your stored recordings, in the app’s settings at any time. School-linked accounts are always excluded from model improvement. This license ends when your content is deleted from the Service, except for limited records we must keep by law.
9Acceptable use
You agree not to:
- Reverse engineer, decompile, scrape, or access the Service with automated tools.
- Probe, bypass, or interfere with security, rate limits, or usage metering.
- Use the Service to create harmful, abusive, unlawful, or infringing content, or to harass others.
- Submit content you do not have the right to use.
- Resell the Service or share one account across multiple people.
- Abuse free trials, promotions, referral programs, or subscription rules.
We may suspend or restrict accounts that violate this section while we investigate.
10School programs
If your account is connected to a school through WitSpeak for Schools, your school may manage aspects of your access and see your class assignments, learning progress metrics, and — only with the consent you give when joining the class — written transcripts of your practice sessions, other than sessions you mark private. Teachers and schools never receive your voice recordings, and school-linked accounts’ practice audio is never used to improve our models, as described in the Privacy Policy.
Students below the digital-consent age of their country need the consent of a parent or guardian before their class membership is activated: either through a consent link we send to the parent, or through the school confirming it holds written parental consent on file. The school is responsible for having the authority to enroll its students, for the accuracy of any parental-consent confirmations it makes, and for obtaining any consents required of it under local law. Separate written agreements with schools take precedence over these Terms where they conflict.
11Intellectual property
The Service — including the app, brand, design, software, lesson content, feedback formats, characters, and learning materials — is owned by ZenithNexus AI Technologies LLC or its licensors and is protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable license to use the app for your own learning while these Terms are in effect.
12Service availability and changes
We are constantly improving WitSpeak. Features may be added, changed, or removed, and the Service may occasionally be interrupted for maintenance or reasons outside our control. We do not guarantee uninterrupted availability.
13Disclaimers
The Service is provided on an “as is” and “as available” basis, without warranties of any kind, express or implied, to the fullest extent permitted by law. WitSpeak does not guarantee any specific score, result, improvement, exam outcome, or error-free operation.
14Limitation of liability
To the fullest extent permitted by law, ZenithNexus AI Technologies LLC will not be liable for indirect, incidental, special, or consequential damages, or for loss of data, profits, opportunities, or exam results, arising from your use of (or inability to use) the Service. Our total liability for all claims relating to the Service is limited to the greater of (a) the amounts you paid us in the 12 months before the claim and (b) USD 100.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
15Termination
You can stop using WitSpeak at any time and delete your account in the app’s profile settings. We may suspend or terminate access if you materially violate these Terms or misuse the Service. Upon termination, your license to use the app ends; sections that by their nature should survive (such as intellectual property, disclaimers, and limitation of liability) survive.
16Governing law and disputes
These Terms are governed by the laws of the State of Florida, USA, excluding its conflict-of-law rules. If you have a concern, contact us first at support@witspeak.ai — most issues can be resolved quickly and informally. Disputes that cannot be resolved informally will be handled by the courts located in Miami-Dade County, Florida, except where the mandatory consumer-protection laws of your country of residence provide otherwise; those rights remain unaffected.
17Changes to these terms
We may update these Terms from time to time. When we do, we will revise the effective date at the top of this page, and for material changes we will give you reasonable advance notice (for example, in the app or by email). Continued use of WitSpeak after changes take effect means you accept the revised Terms.
